The Victorian Government has approved Planning Scheme Amendment VC304, extending the expiry date of Clause 52.04 for dependent person’s units (DPUs) to 28 March 2027.

While this extension provides more time for homeowners to consider this pathway, there is a critical distinction that must be clearly understood.

A dependent person’s unit is not an investment product.

What Has Changed?

The expiry date for Clause 52.04 has been extended to 28 March 2027

No other changes have been made to the policy.

  • The criteria remain the same
  • The purpose remains the same
  • The limitations remain the same

What Is a Dependent Person’s Unit (DPU)?

A DPU is a self-contained dwelling on the same lot as an existing home, intended for a dependent person.

This may include:

  • Elderly parents
  • Individuals with a disability
  • Family members requiring ongoing care

Important: What a DPU Cannot Be Used For

This is where confusion often occurs.

  • A DPU cannot be rented out
  • It cannot be used as an investment property
  • It is not designed to generate income

The approval pathway exists specifically to support dependent living arrangements — not to increase rental yield or property investment returns.

If your objective is to:

  • Generate rental income
  • Add investment value

A different pathway, such as a small second dwelling (SSD), may be more appropriate.

Planning Permit Considerations

While Clause 52.04 provides a streamlined pathway, it does not override site-specific controls.

A planning permit may still be required depending on overlays, including:

  • Bushfire management overlays
  • Flood or inundation overlays
  • Other planning controls affecting the land

Each site must be assessed individually.

Benefits of a DPU compared to an SSD

Where a DPU can be advantageous is in its design flexibility.

  • Can exceed 60sqm
  • Less restrictive design limitations
  • No requirement for a 1:14 accessible pathway

This allows for more comfortable, liveable outcomes for occupants who require care or support.

Why This Extension Matters

This extension provides additional time for families to plan the right solution.

DPUs are best suited for:

  • Supporting ageing in place
  • Keeping family members close
  • Creating safe, independent living within an existing property
